Organizational Structure

The following amendment to the constitution and by-laws concerning the organizational structure and procedure for appointing Governing Official, relieving Governing Official of jurisdictional authority and appeals process of dismissed Governing Officials was adopted and approved by a majority of the members present at the Annual General Meeting of Canadian Gujarati Christchurch, held on January 24, 2016 at Brampton, Ontario.

The governing official (President) will be nominated by the congregation at the Annual General Meeting and will be selected by majority vote of the members and will serve for a consecutive term of three years to be reaffirmed annually with a one year break after two terms.  

The chosen governing official shall be relieved of jurisdictional authority under the following circumstances:    

  1.  The relationship is terminated by either his/her resignation. Should the governing official terminate the relationship a minimum 30-day notice should be given.    
  2.  Dismissal by voting of the majority of the members of the General Body held in January each year or a special General Body Meeting called at any time, if the governing official fails to perform his/her duties efficiently or his/her conduct causes harm to the interests of the church.    
  3.  After the end of appointed term of three years.    

The decision of relieving governing official of jurisdictional authority will be notified to the dismissed official by a written notice by the Secretary and the information would also be submitted immediately to the Marriage Office by the Secretary of the Administrative Board  

The dismissed governing official is permitted to appeal to the board of directors of the Canadian Gujarati Christchurch, who will present the appeal to the general body of the church and efforts will be made to resolve the dispute within the organizational setup of the church. 

The decision of the general body will be final and abiding to all the parties. 

However, the dismissed officials will have right to appeal to the court of justice in case the dispute is not resolved within the church.
